Republicans Urge Justice Department to Investigate Former Prosecutor

House Judiciary Committee Chairman Jim Jordan, a Republican representing Ohio, penned a letter to the Justice Department late Wednesday evening. In his correspondence, Jordan argued that Smith “seemingly made willfully and intentionally false statements” while answering questions under oath during his December appearance before Congress.

This criminal referral of Smith represents another significant development in what has become a sustained campaign by the Trump administration alongside congressional allies. Their efforts target individuals who previously conducted investigations into the former president. The Justice Department has already attempted to pursue criminal cases against former FBI Director Jim Comey and New York Attorney General Letitia James as part of this broader initiative.
Smith has consistently been among Trump’s most vocal critics on social media platforms. The former president expressed his satisfaction with the latest development, posting “Justice at last???” in the early morning hours of Thursday as news of the criminal referral spread across media outlets.
As a former head of the Justice Department’s public integrity unit, Smith supervised two major criminal investigations into Trump’s conduct. Grand juries returned indictments against Trump for alleged interference in the 2020 presidential election and for reportedly refusing to surrender classified materials gathered at his Mar-a-Lago resort in Florida. Both legal proceedings concluded before reaching trial, largely because Trump secured victory in the 2024 election and returned to occupy the White House.
“This referral reflects a chilling eagerness to weaponize the justice system by attacking a career, nonpartisan public servant who faithfully and fearlessly performed his duties by following the facts and the law,” wrote Smith’s lawyers Lanny Breuer and Peter Koski.
Legal representatives for Smith responded with their own letter addressed to Jordan and the Justice Department on Wednesday evening. They maintained that Smith had provided “truthful, responsive answers” to congressional questions during his previous testimony.
Rep. Jamie Raskin, a Maryland lawmaker serving as the ranking Democrat on the Judiciary Committee, offered a sharp critique of the referral. She stated that the action would be “laughed out of court” if it ever proceeded to a federal judge for consideration.
“This referral deliberately distorts and misstates the facts, including what questions the Republicans actually asked at Mr. Smith’s interview,” Raskin said. “Jack Smith could not have lied because Republican Members never even asked the question their theory is based on.”
The central issue involves subpoenas that Smith’s prosecution team issued for phone records belonging to lawmakers who communicated with senior White House officials and their allies approximately six years ago. Additionally, Smith collected text messages from the National Archives documenting exchanges between White House aides and legislators. According to Smith’s attorneys, Republican lawmakers never directly questioned him about these records during his testimony. They now seek to hold Smith accountable for failing to “proactively disclose that” information on his own initiative.
